    Windsor and Maidenhead share a local authority. Our office is in the borough, we submit searches to RBWM routinely, and we are familiar with its planning and building control records.

    That is a modest practical advantage rather than a dramatic one — but it does mean we know the current turnaround times and where historic records sit.

    Extensive conservation areas

    Windsor town centre and much of the surrounding area falls within conservation areas. The consequences for property transactions are real:

    • Permitted development rights may be restricted, including by Article 4 directions in some locations
    • Alterations that would be unremarkable elsewhere may have required consent here
    • Tree works may require notice to the council
    • Replacement windows, doors, roofing materials and boundary treatments can all be controlled

    Where a property has been altered, the question of whether the correct consents were obtained carries more weight than in an unrestricted area. We raise enquiries specifically on this.

    Listed buildings

    Windsor has a high concentration of listed buildings, particularly in the older streets near the castle and along the river.

    Two points matter. First, works to a listed building without listed building consent are a criminal offence, and there is no time limit for enforcement.     If you are buying a listed property, expect the enquiries to be more extensive and the timescale longer. That is the work being done properly.

    Crown Estate and institutional landholdings

    The Crown Estate holds substantial land in and around Windsor, including the Great Park and adjoining areas. Some properties are held on leases from institutional landlords rather than as straightforward freeholds.

    Where that applies, the lease terms, any restrictions on use or alteration, and the position on renewal all need examining. It is not unusual, but it is not standard either.

    The Thames and flood risk

    Windsor, Eton and Datchet all sit close to the Thames, and parts of each fall within Environment Agency flood zones. The Jubilee River flood alleviation scheme provides protection to parts of the area, though not uniformly.

    For conveyancing this changes which authority receives the search. We confirm from the address rather than assuming from proximity.

    A higher-value market

    Windsor property values sit above the Berkshire average, which has consequences beyond the purchase price. More estates come within inheritance tax range, higher SDLT bands apply more often, and the additional property surcharge bites harder on second homes and buy-to-let.
